1. Definitions

In these Terms & Conditions: "Tockwell", "we", "us", and "our" refer to the watchmaking workshop operating under the name Tockwell at 22 Jalan Dewan Sultan Sulaiman, 30000 Ipoh, Perak, Malaysia. "You" or "Client" refers to any individual engaging our services or using our website. "Service" means any watchmaking service provided by Tockwell, including Routine Care Visit, Movement Rebuild, and Devotional Restoration. "Agreement" means these Terms & Conditions together with any service scope document agreed in writing between the parties.

2. Acceptance of Terms

By using our website or engaging our services, you confirm that you are aged 18 or over and have the legal capacity to enter into a binding agreement. Continued use of our website constitutes acceptance of these terms. Engagement of a service constitutes your acceptance of these terms as they apply to that service.

3. Service Description

Tockwell provides professional watchmaking services including periodic maintenance, full movement rebuilds, and comprehensive restoration work. Services are available to clients in Malaysia. Our watchmakers are trained professionals, and all work is carried out in our Ipoh workshop. We reserve the right to decline any piece that falls outside our competency, and will advise you honestly if this is the case.

4. Service Engagement and Scope Agreement

All services begin with an assessment. Following assessment, we will provide you with a description of findings and a proposed scope of work including indicative cost and timeline. No work commences until you have provided your explicit agreement to the proposed scope. Scope is documented in writing. Any additional work discovered during a service is communicated to you before proceeding, and your consent is sought afresh.

5. Pricing and Payment

Service pricing is stated as from-rates. The final price is agreed in writing before work begins and will not exceed the agreed figure without your prior written consent. Payment is due upon collection of the completed piece. We accept payment by cash and online bank transfer. We do not accept credit or debit card payment at this time. Currency is Malaysian Ringgit (MYR). We do not apply hidden fees or charges.

6. Client Responsibilities

You are responsible for providing accurate information about your watch and your expectations for the service. You warrant that you are the lawful owner of any timepiece presented for service, or that you have the authority of the owner to present it. You are responsible for collecting your watch within thirty days of notification that the service is complete. We reserve the right to charge reasonable storage fees for pieces held beyond this period.

Prohibited conduct

• Presenting a watch for service without lawful ownership or authority
• Providing false or misleading information about a watch's history or condition
• Using our website in any manner that disrupts or harms its operation

7. Intellectual Property

All content on our website, including text, images, and design elements, is the intellectual property of Tockwell or used under licence. You may not reproduce, distribute, or commercially exploit this content without our prior written permission. A limited licence is granted for personal, non-commercial viewing of our website.

8. Custody and Insurance

Tockwell exercises professional care over all pieces in our custody. We hold appropriate business insurance covering items in our care during the service period. For pieces of exceptional value, we recommend discussing custody arrangements at the point of engagement so that appropriate provisions can be made. We are not liable for pre-existing damage to a piece that was not identified in the initial assessment.

9. Cancellation and Collection

You may cancel a service engagement at any point before work commences, without charge. If work has begun, reasonable charges for time and materials already expended may apply. The agreed scope may be modified at your request subject to mutual agreement; changes to timeline and cost resulting from scope changes will be discussed and agreed before proceeding.

10. Disclaimers

Tockwell's services are provided by skilled professionals exercising care and judgement. However, watchmaking involves inherent uncertainties, particularly with aged or unusual movements. We make no commitment regarding specific performance outcomes, except where expressly stated in a service agreement. Our assessments represent informed professional opinion, not a warranty of specific results.

11. Limitation of Liability

To the extent permitted by law, Tockwell's total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service in question. We are not liable for indirect, consequential, or incidental losses. Nothing in these terms excludes liability for death or personal injury caused by negligence, or any liability that cannot be excluded under Malaysian law.

12. Indemnification

You agree to indemnify and hold harmless Tockwell, its principals, and staff from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misrepresentation, or your provision of a watch to which you did not have lawful title.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or our services shall first be subject to good-faith negotiation between the parties. If unresolved within thirty days, disputes may be referred to mediation or the jurisdiction of the courts of Perak, Malaysia.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected in the effective date at the top of this page. Continued engagement of our services following any update constitutes acceptance of the revised terms.
